1. Organization - applicable rules
The tourist package covered by this contract is organized by "Luigi Desiderio Rossi - individual firm -" (later LDR), C.so Vittorio Emanuele II, 13, 66041 Atessa (Ch), Italy. Tel. +39 338 547 1672, +39 349 377 6811, +39 347 383 1811. The contract is governed not only by these general conditions, but also by the clauses indicated in the travel documentation delivered to the customer. Said contract is also governed by D.L. 79 of 23.5.2011 (Tourism Code), by Law No. 1084 of 27/12/1977 ratifying and implementing the International Convention on the Travel Contract (CCV) signed in Brussels on 23/4/1970 as well as by the Consumer Code referred to in D.L. No. 206 of 6/9/2005.

Certain documents and/or information and/or communications, also taking into account the type of service offered by the organization, may be provided to the participant in writing in a foreign language (English, French, German, Spanish), even during the execution of the contract: in any case, no responsibility can be attributed to LDR for any consequences resulting from the incorrect understanding of the information provided.

2. How to register and Balance
Enrollment can be done by filling out the "online subscription" posted at www.italianstudytrip.com, or by completing the application in PDF (editable) format and sending it to LDR by mail. The application must be completed in its entirety and signed where required, after reading the "Terms and Conditions."

Deposit: the application must be accompanied by a deposit of 350 euros; this amount will be deducted from the invoice sent by LDR for the balance within 30 days before departure.

The down payment can be made through Bank transfer at "BCC Abruzzi e Molise" Bank to:

The bank receipt of the transfer order should be sent to LUIGI DEISDERIO ROSSI, info@italianstudytrip.com, at the same time as the request for prebooking the stay. ALWAYS INDICATE THE NAME OF THE PARTICIPANT in the reason for payment.
N.B. A reservation request received without a deposit will not be considered valid.

Balance: The remaining fee must be paid 30 days before departure, upon receipt of the invoice sent by LDR, using the same payment methods described for the down payment.
For the reservation of the stay made in the 30 days prior to departure, the full amount must be paid at the time of registration.
If the balance is not paid by the deadline LDR has the right to terminate the contract for default.
Subscription time: although no limit is imposed, we recommend that you register at least 4 weeks in advance for stays in low season and 12-16 weeks for summer stays, especially if it is a study holiday for children.
In the case of a study vacation, LDR reserves the right to refuse enrollment if a course is full; in this case the deposit paid is immediately and fully refunded.

3. Changes in the tour package
Rates may be subject to change (up to 21 days prior to departure) as a result of administrative/tributary changes in Italy or the foreign country or changes in exchange rates. If it becomes necessary to apply an increase of more than 8% of the published rate, the member may withdraw from the contract provided that he/she gives written notice to LDR within 3 days of receipt of the notice regarding the increase.
In case of changes by the customer with respect to the reservation made at the time of registration, the participant will be charged a lump sum of € 30 as a refund of expenses to LDR, provided that the change requested does not result in additional charges for cancellation penalty by the providers of services affiliated with LDR. LDR reserves the right to cancel the stay or study vacation if the minimum number of participants is not reached or due to circumstances that cause force majeure. In this case, the customer already registered will be refunded the total amount paid, without further compensation.

4. Waivers
Any cancellation by the participant must be confirmed in writing by registered letter or telegram sent to LDR. In case of cancellation, the participant incurs the following cancellation penalties, calculated on the entire participation fee:
- 10% up to 30 days before departure
- 30% up to 21 days before departure
- 50% up to 11 days before departure
- 75% up to 3 days before departure
- no refund after this deadline and in case of no-show at departure, waiver during travel, lack or inaccuracy of personal expatriation documentation. The 45 euro fee related to "practice management fees" is never refundable.
Pursuant to art. 32, co. 2 Tourism Code, the customer is informed of the exclusion of the right of withdrawal provided for contracts signed at a distance (art. 52 and ss. of Cod. del Consumo, D.L. 6.9.2005, n. 206 amended following D.L. 21/2/2014 n. 21)as regards the provision of services such as accommodation, transport, leisure activities or other services constituting a significant part of the "package tour", where the contract provides for a specific date or period for the provision of services. Therefore, the cancellation fees indicated above are applicable to the customer who withdraws from the contract signed outside the LDR offices.

5. Substitutions
For the stay of adults: the customer who is unable to use the package tour, may assign the contract to a third party, provided that: a) these meet all the conditions and requirements for the use of the services covered by the package holiday; b) LDR is informed in writing at least 4 working days before departure, at the same time receiving communications about the identity of the transferee. Following the assignment, the transferor and the transferee are jointly and severally liable for the payment of any balance and expenses arising from the assignment, fixed in euro 30.

6. Obligations of participants
Participants must have a passport or other document valid for travel abroad. They shall also abide by the rules of normal prudence and diligence, as well as the regulations and legislative provisions relating to the package tour. They will be held liable for all damages that LDR may suffer as a result of their failure to comply with the aforementioned obligations.

7. Condition valid only for study vacation of minors
Each student must abide by the general rules and regulations-as well as those specific to his or her age group-established by LDR.
As for day or evening outings, as specified in the registration form, parents are required to take a look before formalizing membership.
During excursions, students depending on their age have the opportunity to get away from the staff (in a limited area, for a limited time, and in groups with other children) to go shopping. Also with regard to the exits, for the cases in which the parental authorization is required, the information indicated by them on the Application for registration is authentic; as any way must be respected the conditions and return times established by the accommodation facilities affiliated with LDR. The latter disclaims all liability relating to the safety of the participant in the study holiday if he does not comply with what established and indicated by LDR.
Emergencies - in cases of emergency, in the impossibility of contacting a parent LDR will take all the necessary measures (medical treatment, hospitalization, surgery) dictated by the condition of the participant and according to the instructions of the medical staff. Consent to use image - During the LDR study stay, LDR can take photos and videos in order to enrich its promotional material that can then be distributed through different media such as brochures, CDs, DVDs, web. These photographs have no commercial or contractual value and parental consent is granted free of charge. If the parent is opposed to the use of the image of his child must indicate this on the registration form at the same time attaching a letter addressed to LDR (the letter, which will be written in English, must also contain the name and surname of the child, the dates of the stay, first and last name of the parent signer). Please note that LDR may not accept participants for whom consent has not been given. Proper behavior is required of every student; in case of serious infractions (including bullying; use/possession of cigarettes or drugs or alcoholic beverages; non-compliance with regulations or established timetables for outings; theft in a store, or in the facilities where it is housed), LDR reserves the right to immediately repatriate the responsible student, upon notice to the parents, without any refund and at the expense of the family members.

8. Personal Data
Personal data provided to LDR at the time of booking are processed in accordance with EU Regulation No. 2016/679 so as to ensure the security and confidentiality of the same. The data will be communicated by LDR only to the suppliers of the services included in the tour package and will not be transferred to third parties. 9. Insurance
- Pursuant to Article 20 of Legislative Decree 111 of 17/3/95, LDR has taken out insurance policy No. ................ for Third Party Liability with ...................... SpA.


10. Liability
LDR shall be liable for any damage caused to the participant as a result of the total or partial non-performance of the services contractually due, whether they are performed by LDR or by third party service providers, unless the non-performance or inaccurate performance of the contract is attributable to the participant itself or results from unforeseeable circumstances, force majeure, or circumstances that LDR could not, according to professional care, reasonably foresee or resolve. The liability of LDR towards the participant for any damages suffered due to the failure or incorrect performance of the obligations provided for by this contract is governed by the laws and international conventions referred to in art. 1. Therefore, LDR’s liability may in no case exceed the limits laid down by the above mentioned laws.

11. Claims LDR is committed to best defending the interests of the participants and therefore in case of dissatisfaction please report it immediately on the spot so that it is promptly remedied. A claim can be made by sending a registered letter with return receipt to LDR within 10 days from the date of return.

N.B. It can happen that at the last moment a structure of affiliated receptive services or in any case another provider with which the participant will have to deal cannot maintain the commitment made due to problems occurred suddenly; in this case, the participant is informed of the address of a new structure. In these circumstances, LDR cannot be held liable and cannot therefore be complained about.

How to subscribe your partecipation
You can fill in the online application form or download and complete the PDF application form. The application must be completed in full and signed where required, after reading the "General Conditions". If the participant is a minor, the application must be signed by the parents or by the person acting on their behalf. Send by email to info@italianstudytrip.com, the application must be accompanied by a copy of the transfer of the 350 euro deposit.


Registration time
Although no limit is imposed, we recommend that you register at least 4 weeks in advance for stays in low season and 8-10 weeks for summer stays; a larger advance is appropriate for enrolling in study holidays for children and teenagers. Also consider that the wider the notice the greater the opportunities to book your flight at a discounted rate. N.B. We emphasize that the "last minute" registrations until a few days before departure are still accepted, subject to availability.

Payments
The reservation of the stay must be accompanied by a down payment of 350 euros; this amount will be deducted from the invoice for the balance sent by LDR within 30 days before departure.

Subscription confirmation
Once the registration is received, LDR will send the participant the confirmation of the booking with the first information about the stay, followed by the invoice for the balance, address of accommodation abroad for the completion of travel documents travel documents.

Flight booking
LDR doesn't organize group departures from any foreign city, EXCPET FOR ACTIVITIES EXCLUSIVELY RELATED TO THE STUDY VACATION FOR ITALIAN LANGUAGE COURSES. For this reason only the round-trip flight from New York's JFK International Airport to Rome's Leonardo Da Vinci International Airport is included in the vacation package offered by LDR. In addition, again with regard to the student learning vacation, the domestic flight in the U.S. or other form of transportation to reach JFK International Airport and for the return from the same airport to one's residence remains the responsibility of the participant. NB. It is recommended to purchase the ticket to reach New York JFK International Airport AFTER receiving confirmation of participation from LDR.
For language courses to minors: LDR will offer flight packages upon reaching the number required to run a course. Regarding the minor, please note that airlines have different regulations and age limits, so in order for LDR to book the ticket it will be necessary to verify with the airline that the child can travel alone without being accompanied by an adult, and without specific constraints for international versus domestic routes.

UM Procedure (Unaccompanied Minors)
For minors under 18 years of age traveling alone, some airlines provide special procedures such as the “unaccompanied minors” procedure; this means that upon departure, children are entrusted to the airline's staff, who in turn will entrust them to an LDR representative at the arrival airport. Companies have different regulations and age limits (this procedure can be extended up to 15 years of age, and as an optional service beyond that), so it is advisable to check this particularity when booking the flight. LDR will provide parents with the name to be communicated to the airline for reception at the arrival airport.

Flight times and transfer of CHILDREN
For junior programs (in our case in the age range from 15 to 19 years) flight schedules are subject to those of transfers organized by LDR; for more information request details from LDR.
Transfer: upon arrival, after picking up the baggage and passing customs, the kids are greeted by a person of the LDR staff (he will carry a sign with the LDR logo and the name of the group leader) that will accompany everyone to the final destination, Either, or, while waiting to leave, to a place in the airport supervised by LDR staff.
If the flight is delayed, LDR staff will remain at the airport until they have been able to pick up the group.
The transfer is usually made by bus, but depending on the time of arrival and the length of the journey can also be made by minibus or train.
N.B. For courses organized for children, the transfer is usually included in the rates, except for rare exceptions; in any case, for more information, apply to LDR.
Specific information about the transfer is contained in the documents provided by LDR to the participant before departure.

Flight times and transfer ADULTS
For study stays for adults in general the most indicated times are: arrival on site in the late morning or afternoon (preferably avoid the evening after h. 20.00); return preferably in the afternoon (avoid early morning).
For accommodation in the partner accommodation facilities, it is advisable to inquire in advance at the LDR about the reception and key collection times.
Transfer: as a rule also in the adult stay we offer a transfer service from the airports; but if for different reasons due to the needs of the participant the transfer becomes an optional, it will not be included in the rates. So if there are any particularities of the participant regarding the transfer it is necessary to contact LDR. N.B. If the transfer to Atessa takes place independently of the participant, in most cases it is easier and cheaper to use the railway.

Expatriation documents for adults and minors
Since these provisions may vary from country to country, especially in the case of minors, before leaving we recommend that you check their validity at the appropriate authorities of your country of origin.
